Chapter 13 Bankruptcy – Don’t ignore your paycheck

Paycheck

When you file for Chapter 13 bankruptcy your first plan payment is due 30 days after your case is filed. In most cases a pay or wage order will be filed and a portion if not all of your payment will be withheld from your paycheck.

If you are self-employed you are responsible for making your plan payments.

So when you get your first paycheck after your case is filed, you need to study it carefully. If your employer has not withheld the appropriate amount from your paycheck then you need to make your plan payment. You want to start off your plan on the right foot.
